Labor Relations

Labor relations represent the set of legal relationships between employers and employees, regulated by labor legislation, collective and individual labor agreements. In Romania, the Labor Inspection plays an essential role in monitoring and ensuring compliance with these regulations.

Responsibilities of the Labor Inspection in the Field of Labor Relations

  • Control of the application of legal regulations: Verifies compliance with legislation regarding the conclusion, execution, modification, suspension and termination of individual labor contracts.
  • Supervision of employees' rights: Ensures the granting of rights due to employees according to the law and labor contracts.
  • Promotion of equal opportunities: Monitors the application of measures to ensure equal opportunities and treatment between women and men.
  • Management of labor records: Maintains the general register of employee records and the register of day laborers.
  • Combating undeclared work: Identifies and prevents cases of undeclared work.
  • Administration of employer and day laborer data: Electronically processes the information provided by employers and beneficiaries regarding employees and day laborers.
  • Registration of collective labor agreements: Ensures the registration and verification of collective agreements at the unit level and conciliates labor disputes.

Rights and Obligations of Employees

Employees benefit from fundamental rights, such as:

  • Fair remuneration: The right to a salary established through negotiation or according to the minimum wage in the economy.
  • Working and rest time: The normal duration of working time is 8 hours per day and 40 hours per week. Overtime work must be compensated with paid time off or salary increases.
  • Leaves: The right to paid annual leave, medical leave, maternity/paternity leave and other leaves provided by law.
  • Safe working conditions: The right to a healthy and safe working environment.
  • Professional training: Access to professional training and development programs.

Employees' obligations include:

  • Respect for labor discipline: Performing job duties according to the job description and compliance with internal regulations.
  • Confidentiality: Maintaining the confidentiality of information to which they have access during their professional activity.
  • Compliance with safety standards: Applying occupational safety and health measures.

Rights and Obligations of Employers

Employers have the following rights:

  • Establishing work organization: The right to organize and coordinate the activity of employees.
  • Performance evaluation: The right to evaluate and monitor the professional performance of employees.

Employers' obligations include:

  • Compliance with labor legislation: Correct application of legal provisions in the field of labor.
  • Payment of salaries: Ensuring the timely payment of salaries and other financial rights.
  • Ensuring working conditions: Creating a safe and healthy working environment.
  • Informing employees: Providing relevant information regarding the rights and obligations of employees.
  • Registration of labor contracts: Drafting and registering individual labor contracts in the general register of employee records.
